Lawyer for the families of the eight victims
miner in the "Soko" mine in Sokobanja, Bratislav Stojanović announced that he is submitting a constitutional appeal to the Constitutional Court of Serbia due to
violations of the right to fairness trials, RTS reported today.
Stojanović said that he believes that the collection of evidence in the proceedings before the Basic and Higher Public Prosecutor's Office in Niš was conducted in an illegal manner.
"I was not allowed to use all procedural powers related to the supplementary expert opinion from the committee of the Faculty of Mining and Geology, with my proposal to determine the state of methane concentration from the beginning of work in the third shift, on the critical night, starting at 23 p.m. and all until 4.00", said Stojanović.
It was suggested that the decision of the Higher Public Prosecutor's Office in Nis be annulled and the case returned for retrial or that the families be paid compensation for mental pain in the amount of 50.000 euros. The higher public prosecutor's office three times dismissed the criminal complaint filed by the relevant ministry against the mine managers.
