Appeals from the Higher Public Prosecutor's Office in Belgrade were accepted and custody was ordered for two suspects who attacked police officers at the protests.
One of the two assigned to him detention is Marko Marjanović (39), a Twitter user known by the name Crystal Matt Damon.
Decisions on the modification were made by the non-trial criminal panel of the High Court in Belgrade, contrary to the position of colleagues, the judges for the preliminary proceedings who had previously refused to remand them in custody.
Let us remind you that on August 19, the media announced that all the judges of the Department for Preliminary Proceedings of the High Court in Belgrade held a session, where they considered the legal qualification of the criminal offense for which protest participants were brought to their attention en masse in those days, with the request of the High Public Prosecutor's Office that all of them be remanded in custody.
The judges unanimously took the legal position that the criminal offense, whose "act of execution" is a physical attack and confrontation (which includes shooting with potentially dangerous objects) aimed at police officers who are performing their duty at that moment - cannot be qualified as violent behavior at a public meeting, but exclusively as an attack on an official in the performance of his official duty.
An attack on an official in the performance of official duties is the responsibility of the basic prosecutor's offices, while violent behavior at a public meeting is the responsibility of the Higher Public Prosecutor's Office.
The Chief Public Prosecutor of the High Court in Belgrade, Nenad Stefanović, then sent a letter to the Department of the High Court in Belgrade for preliminary proceedings. He told them that "he considers their position on the qualification of certain actions unfounded, irregular and illegal and that he will challenge it in the legally prescribed procedure."
Lawyer Ivan Ninić commented that "it is difficult to understand the need of Nenad Stefanović, as the head of the prosecution, to be the head of the judges and to subordinate the judges to the Higher Public Prosecutor's Office in Belgrade".
