2.453 candidates applied for 5.050 judge positions. The High Council of the Judiciary discussed them for almost 400 working hours, after which it elected 1.531 judges and 876 candidates for judges to be elected by the Serbian Parliament, while 46 positions remained vacant.
From the Criminal Division of the Supreme Court, even half were not re-elected at all, and only three were elected to the Supreme Court of Cassation, including Nata Mesarović, the president of that court and the High Council of the Judiciary. Among those who were not re-elected are the president of the Criminal Division of the Supreme Court and the presidents of four criminal chambers, out of five in total. The union of employees in judicial bodies announced yesterday that an urgent explanation must be given for those who did not pass re-election. The Association of Judges of Serbia announced that it will consider judges who were not re-elected as members, until they receive explanations from the High Council of the Judiciary on the reasons why their colleagues were not re-elected. By the way, the president of the Association of Judges, Dragana Boljević, who was a judge of the District Court in Belgrade, was not elected to any judicial position.
During the press conference at which the decision was announced, in addition to journalists, there were some judges of the Supreme Court of Serbia who were not elected. Without naming names, judge Nata Mesarović explained that a number of judges put themselves in a situation of not being elected or losing their judicial function.
"First of all, I am thinking of the judges who applied for only one court and that for the highest ranking court. This was most reflected in the judges of the current Supreme Court of Serbia. "A good number of judges applied only for the Supreme Court of Cassation," explains Mesarović.
"Each specific case was approached seriously and no decision was taken by heart." On this occasion, I would like to say to those who doubt that the High Council worked in an objective manner, that we are ready to accept a public discussion of those candidates who believe that such a decision regarding the worthiness of a candidate can be challenged," says Mesarović.
Among the judges who were not elected is the president of the Association of Judges of Serbia, Dragana Boljević. "I interpret the decision not to be elected as a clear message to the judges who remain - take care of how you behave, don't criticize." It's up to you to keep quiet, to listen and to work," says Boljević.
However, Nata Mesarović answers that each judge can see where he is according to the results of his work among the published criteria. When asked why Dragana Boljević was not elected president, she said that some judges were handicapped due to statistics and the number of resolved and unsolved cases.
Answering a question about the criteria that influenced the selection of the former president of the Republican Election Commission, Sonja Brkić, to the position of judge of the Supreme Court of Cassation, Mesarović emphasized that the High Council "found that she was worthy" for the position.
"As the president of the RIK, Sonja Brkić, like everyone else who was in that position, was legally entitled to monetary compensation," said Mesarović, answering the question of whether Sonja Brkić was worthy of being due to the compensation scandal elected as a judge of the Supreme Court of Cassation.
Minister of Justice Snežana Malović told Politika that certain people from the judiciary pressured and even threatened the Ministry in the process of selecting judges and prosecutors.
As "Blic" writes, a judge of the Supreme Court who was not re-elected broke into the office of the Minister of Justice of Serbia, Snežana Malović, after the session of the High Council of the Judiciary on the general election ended. That judge came in unannounced, the minister was alone in the cabinet, and he angrily reproached her for not being re-elected. There were similar calls from lawyers' circles, but there were insults and threats directed at female ministers. After these events, the security of the Minister of Justice has been increased and will be with her at all times. Minister Malović confirmed for "Blic" that there were pressures and threats, but that they did not influence the final decisions.
Association of Judges of Serbia requested from the High Council of the Judiciary an explanation of the reasons why some judges were not re-elected to judicial office. "The Association of Judges of Serbia calls on the High Council of the Judiciary to give to the appointed, but unelected judges, an explanation of the reasons for which it was concluded that these judges are not professional, qualified and worthy, and thereby comply with the suggestions given in the opinion of the Venice Commission", it was stated in the announcement of the association of judges.
Member of the Society of Judges Omer Hadžiomerović said that 700 judges who were not elected were de facto relieved of their duties, and that the selection procedure was "non-transparent and that the unworthiness and incompetence of someone to perform the function of a judge must be determined in a special procedure, for which the judge would have the right to a legal remedy". Hadžiomerović announced that he will form a legal team that will be at the disposal of the judges who were not elected. That association will not exclude from its membership judges who have not been elected until they receive a written explanation of the decision of the Supreme Court and until the legal remedies proceedings are completed. In a statement quoted by RTS, he recalled that the Venice Commission in its opinion dated June 15, 2009 indicated that it is necessary for every judge who is not elected to receive a reasoned decision as to why he was not reelected, as well as to provide him with an effective legal remedy.
Hadžiomerović assessed that unelected judges can only appeal to the Constitutional Court to which they can submit a constitutional appeal, after which, if they are not satisfied with the decision of the Constitutional Court, they can seek protection of their rights before the European Court of Human Rights in Strasbourg.
The Union of the Judiciary of Serbia on Thursday asked the High Council of the Judiciary and the State Council of Prosecutors to announce the reasons why some judges and deputy public prosecutors were not re-elected. In the press release of that union, it is said that among the elected judges and prosecutors there are no names of some people who, in the opinion of that union, performed their work competently and professionally.
As reported by TVB92, the re-election of judges also caused indignation in Bar Association of Serbia, whose president, Dragoljub Đorđević, asks for an explanation as to why judge Dragana Boljević was not re-elected, if her colleagues previously appointed her as the first among equals to be the president of the Association of Judges of Serbia.

Former judge of the Municipal Court in Požega, Ljubiša Đurić, who died two months ago, was chosen by the High Council of the Judiciary as a judge in that city, writes "Danas".
The former president of that court, Vitomir Urošević, who was not re-elected, says that he did not inform the High Council of the Judiciary about the death of Judge Đurić, but that he sent a letter about it to the Ministry of Justice. Judge Đurić died suddenly, and the competition he applied for was announced this summer. The Požega court did not inform the High Council of the Judiciary about the death of that judge because, according to Urošević, it had no obligation to do so. However, he claims that the Ministry of Justice was informed about the judge's death, to which requests were made for the expenses of his funeral and that money was paid. That ministry and the High Council of the Judiciary are located in the same building in Nemanja Street in Belgrade.
