The beginning of the repeated trial of the former state secretary in the Ministry of Internal Affairs Dijana Hrkalovic which was supposed to start on Tuesday at Special court it was postponed due to the request to disqualify acting prosecutor Milenko Mandić.
In addition to Hrkalović, the retrial of the former head of the Service for Special Investigation Methods (SSIM) Dejan Milenković was supposed to begin on Tuesday.
Milenkovic sent this request to the court panel because of his "serious doubts about the impartiality of prosecutor Mandić", writes N1.
"With this presentation, I will endanger my safety and that of my family, but I cannot allow prosecutor Mandic to associate me with organized crime, in order to protect himself, because his inaction obstructed the investigation murders lawyer Dragoslav Miša Ognjanović", he stated.
Milenković reminded of what the prosecutor accuses him of - that he committed the criminal offense of abuse of official position for an extended period of time and that, on the order of Hrkalović, he requested to destroy part of the recording of the wiretapped conversation between lawyer Miša Ognjanović and criminal Dragoslav Miloradović.
That conversation took place in May 2018 in a Belgrade restaurant in Vračar, while Miloradović was under police surveillance and wiretapping measures.
Miloradović was killed twenty days later, and lawyer Ognjanović two and a half months after the wiretapped conversation.
During that conversation, Ognjanović spoke about Hrkalović's private life, but also about her connections with criminals and influence in the country.
The Prosecution claims that Hrkalović requested that those parts of the recording of the conversation be deleted.
Alleged obstruction of the investigation into the murder of lawyer Miša Ognjanović
That's why Milenkovic said on Tuesday that "the prosecutor compromised him in his service by linking him to organized crime" and accused the prosecutor of manipulating facts and evidence.
"The prosecutor acts selectively and illegally in order to protect himself. He has a personal interest against me and therefore compromises me. A few days ago, I came to certain knowledge, I connected and cross-referenced everything and I realized that the prosecutor Mandić obstructed the investigation into the murder of lawyer Ognjanović by his inaction, because he was aware of the existence of a potential protected witness, who in the presence of the prosecutor Mandić, two other prosecutors and two police officers stated that he recognized the motorcycle that was used during the liquidation of lawyer Ognjanović, because it is the motorcycle that he stole and that he handed over to a certain criminal group," he stated.
Milenković said that this is a criminal group that cooperates with "scallops" and with the "Kavak" clan, but also with other criminal groups that are tried in the Special Court, but he did not want to mention anyone's name or the clan in question.
"We are talking about a criminal group that is the most dominant in Serbia, and that is why I say that I feel that this statement will endanger me and my family. That potential witness and accomplice of the organized criminal group that killed Ognjanović was deprived of his life. He told the officials of the UKP about his findings, and they made an official note about it in the Internal Control Sector MUP. However, the SUK police officers who requested that the note be removed are the same ones who filed the criminal complaint against me," said Milenkovic over the court speaker.
He also demanded that the Chief Prosecutor for Organized Crime Mladen Nenadić, Supreme Public Prosecutor Zagorka Dolovac, as well as the High Council of Prosecutions be informed about everything and act.
The president of the court panel postponed the start of the retrial of Hrkalović and Milenkovic and scheduled a new hearing for February 20.
