Due to the lack of legal framework, from the beginning of this year until the end of August, not a single transplant of organs from deceased donors was performed, according to the Belgrade Center for Human Rights.
On this occasion, today they sent an initiative to the Ministry of Health, the Government and the Parliament of Serbia to prepare and adopt amendments to the Law on Transplantation of Human Organs and the Law on Human Organs and Tissues as soon as possible.
By the decision of the Constitutional Court in May of last year, parts of the amendments to those laws were declared unconstitutional, which means that there is no legal framework that will enable organ and tissue transplantation from deceased donors.
The Center reminds that the publication of the decisions of the Constitutional Court was postponed for six months, and that this deadline expired at the end of November 2021. According to the information that the Center received from the Ministry of Health, at the end of 2021, two working groups were formed to draft the texts of amendments and amendments to the law that prepared working texts of amendments and additions, but those texts did not enter the legal procedure, considering that the formation of the Government was awaited.
According to the Center's opinion, the texts prepared by the working groups of the Ministry of Health eliminate most of the deficiencies pointed out by the Constitutional Court, but they also contain certain deficiencies that should be eliminated before proceeding with their adoption in the parliament.
It is necessary to urgently start and implement the procedure of establishing a legal framework that governs the conditions and procedure for transplanting human organs and tissues from deceased persons, in order to protect the right of citizens to life and the highest standards of health care, the Center's press release points out.
Currently, about 2000 people in Serbia are waiting for a transplant.
