New court proceedings against the leader of the neo-Nazi organization Nacionalni stroj Goran Davidović following the lawsuit of journalist Dink Gruhonjić for violation of honor, reputation and rights
starts tomorrow at 10 a.m. in the Municipal Court in Novi Sad.
The same court, after a second-level procedure, ruled that Goran Davidović should pay 500.000
dinars to Gruhonjic. However, the judgment was revoked after Goran Davidović complained that part of the court documents were not written in Cyrillic, that is, that the lawsuit was written in Latin. The District Court then assessed that the Municipal Court violated the defendant's rights in the first-instance procedure because "contrary to the provisions of the law, it refused the party's request to freely use its language and script in the proceedings."
The municipal court previously announced that in the repeated procedure it will remove the determined and important violation of the procedure, in accordance with the instructions from the decision of the District Court. That court also announced that at the meeting of the president of the court with department presidents and deputy presidents, held on November 10, 2008, "an oral order and recommendation was given that the Cyrillic alphabet should be used in the proceedings in accordance with the applicable legal regulations, by-laws and the Constitution ". Gruhonjić's lawyer, Vladimir Beljanski, assessed the decision of the District Court as legal "nonsense", because it leads to the conclusion that the Serbian language cannot be written in the Latin alphabet. The lawyer added that the court's decision "leads to nonsense, because in the future every court will be able to act in a similar way, if it was preceded by someone's personal whim."
Gruhonjić sued Davidović because of the allegations in Davidović's book "The National Machine Case".
