Chief Public Prosecutor Nenad Stefanovic he filed another disciplinary complaint against the plaintiff Jasmine Paunović, this time because of her statement to the editorial office of "Danas" regarding the murder of a police officer in Loznica in July of this year. Stefanović reproached the prosecutor for questioning the assessment of the Ministry of Justice that it was a terrorist act.
Stefanović sent the report this time to the address of the Appellate Public Prosecutor's Office in Belgrade and the Chief Public Prosecutor Tomislav Kilibarda.
Stefanović submitted the complaint because of the statement of prosecutor Paunović in the text "The case of the murder of a police officer in Loznica: What judicial steps can be expected?", and it also refers to the statement reported in other media, writes "Danas".
"Absolutely unacceptable personal attitudes"
Stefanović stated in the application that Paunović is acting not in his own name, but presenting himself as a public prosecutor of the Higher Public Prosecutor's Office (VJT) in Belgrade and commenting on a case that has not yet been concluded, while expressing his personal views, "which are absolutely unacceptable".
"In the specific case, public prosecutor Jasmina Paunović, giving her personal opinion on the announcement of the Ministry of Justice that it is a terrorist act, claiming that it is about 'speculations without concrete evidence, which is unnecessary', and that 'it is all politicization that when involved in the profession usually has nothing to do with that job' in the rudest way, using phrases that are not worthy of a public prosecutor, arbitrarily commenting on events that are not the subject of the proceedings of the Higher Public Prosecutor's Office in Belgrade (so that questions are raised where her knowledge related to specific events comes from), while disregarding the provisions of the code of ethics that she is obliged to refrain from any behavior and making statements in public that may threaten the public's trust in the public prosecutor's office," the report says.
Stefanović added that citizens, and even those without a legal education, can take very seriously the claims that the Ministry of Justice, by issuing statements, "deals with politicization, speculations without any evidence, that all cases that are 'politicized' in this way have in the end, a bad outcome", which ultimately can threaten citizens' trust.
"The Chief Public Prosecutor wants to politicize every case"
Paunović submitted a written statement on that occasion.
"I always stand behind my every sentence, spoken or written, because I have been a long-time public prosecutor in the Public Prosecutor's Office and I believe that I am very competent to publicly express my opinion and express my own views," the written statement stated.
All other allegations in the disciplinary report are incorrect and unfounded, emphasized Paunović.
Reacting to part of the report, she pointed out that it is about facts that were given in all the media, so her comments refer only to commonly known facts and not to the content of the case itself.
"Insisting that I give a personal comment on the statement of the Ministry of Justice, in which it is stated that it is a terrorist act and that I state that it is 'speculation without concrete evidence', which I consider unnecessary and that it is all 'politicization that interferes in the profession and usually there's nothing to do with that job' is absolutely correct. "The fact that the chief public prosecutor wants to politicize every case means that he does not want the case to be brought into the professional framework," prosecutor Paunović explained.
She emphasized that every case of the public prosecution should be strictly professional, exempted from the political sphere and given to public prosecutors.
"It remains unclear why the chief public prosecutor is bothered by the fact that I am personally against the politicization of cases that are being worked on," asked Paunović.
