The essence of the transfer of the case on corrupt acts in connection with the works on Railway station in Novi Sad to the Prosecutor's Office for Organized Crime (TOK) is to put that very serious case under control, to disempower it prosecutor for organized crime Mladen Nenadić and bringing a loyalist prosecutor to his place, therefore - damage control, the lawyer tells "Vreme" Ivan Ninic.
Supreme Public Prosecutor Zagorka Dolovac decided that the files of the case from the Higher Public Prosecutor's Office in Novi Sad should be delivered to the Public Prosecutor's Office for Organized Crime.
Prosecutor's move
However, Ninić points out that the transfer of the case is also characterized by a paradox, because not only the case and files were transferred to the TOK, which is the indisputable authority of public prosecutor Zagorka Dolovac.
"She went a step further with the case and moved her prosecutor, Aleksandar Barc, who works in the Higher Public Prosecutor's Office in Novi Sad, and was recently elected as a prosecutor in the Novi Sad Appellate Prosecutor's Office." "The head of state and Zagorka Dolovac want to eliminate Mladen Nenadić and TOK prosecutors who are under Nenadić's supervision from that case," says Ninić.
He adds that this was done because there is a "conflict" between Nenadića, Dolovac and the Minister of Justice, Maja Popović.
"The head of the state is obviously afraid that the prosecutor who is not under the control of the TOK can go too far in the preliminary investigation, direct the investigation in another direction and build his own power through that case," Ninic says.

To keep everything "within the circle of friends"
He points out that Zagorki Dolovac is also at the top of the state, "which serves the top of the state - it is critically important that every paper, action and transaction in the case is carefully analyzed and remains in the circle of friends, in order to avoid any mishaps that are possible if the TOK prosecutor is permanently elected to that position for the sake of the case."
"Aleksandar Barac was sent to help TOK." "He came with a limited mandate and for a limited period, should he not deal with the subject while social tensions last, while students are on the streets," says Ninic.
He believes that Barac would withdraw to Novi Sad if public pressure subsided.
"The bottom line is that everything that happened with the project worth 65 million euros remains in the circle of friends, and there is no doubt that the nine elected TOK prosecutors have the capacity, knowledge and expertise, they just need free hands." By bringing in his prosecutor, Dolovac is tying the hands of Barca, who clearly has no confidence in him. The case was entrusted by a man in whom the government has great confidence, and as the case moves, so does the prosecutor. "Bringing in a loyalist prosecutor is the best example that this investigation will also take place in controlled laboratory conditions and that the public is served, because in the background there are behind-the-scenes actions in judicial corridors and booths that the average citizen can neither see nor understand", Ninic assesses.
He points out that it is important to examine transactions, prices, types and quantities of materials incorporated in the canopy reconstruction.
Contractors undeniably connected to the authorities
He adds that the students are right when they say that the requirements have not been met, because the fulfillment of the requirements means precisely the documentation on the final transactions, which is not available.
"That hydra of 150 subcontractors and hundreds of suppliers is a sign of where the money went." All the money that was used for the reconstruction of the railway station in Novi Sad, but also the railway itself, has its end user. It is only necessary to identify whether these users are companies in the country or companies abroad, legal or natural persons, the founders of those companies and entrepreneurial workers, which is currently an enigma, but they are undeniably connected to the authorities. "If it were not so, the top of the state would not have made such an effort to postpone any investigation into the flow of money and the implementation of the contract for three months," Ninic says.
He assesses that there is no doubt that the people at the railway station in Novi Sad were killed by corruption, and that "the government is burying that corruption so that the whole story does not go into oblivion".
"An indicator that the project is corrupt and that money has been siphoned off is the preliminary cost estimate made by the CIP Institute. If CIP said that something should cost 3,5 million euros, it is not clear how it could end up costing 16 million euros. The fact that 6000 euros per square meter of the reconstruction had to be paid for should have turned on the red lights in the prosecutor's office," notes Ninic.

For which all the accused could be held accountable
He also points out that every prosecutor is independent in his work, so Aleksandar Barac should ultimately assess whether there is room to file an indictment.
"Barac is the one who should sign the arrest warrants, if there are any." "Mladen Nenadić is the formation head of TOK, but the last reform of the judiciary created such a legal foundation that the prosecutor handling the case is practically responsible for him," Ninic explains.
Hypothetically, if there are indictments for those responsible and their arrests, Ninic states that there are numerous criminal acts for which they could be accused.
"These are abuse of official position, abuse of the position of a responsible person, receiving and giving bribes, abuse in the public procurement procedure, money laundering and trading in influence." Engineer Zoran Đajić says that construction diaries were falsified, that the seal and signature of people who were not in the company 'Starting' at the time were put, so the question is whether the certification of business documents with the seal of an engineer who was not employed is an abuse of that person's seal or if it was all done within the framework of a criminal group that made a previous plan to extract as much money as possible and validate all the illegalities in the project itself and create the appearance that the realization of the project was completely legal," Ninic explains.
Who all could be included in the investigation
He also says that, if there is a will, the investigation could be extended to a large number of people.
"Since foreign companies are involved in the project, the prosecutor must request a request for the collection of information and documentation through international legal assistance." This means that the prosecutor, through our Ministry of Justice, must contact other governments and countries, primarily France, China and Hungary, in order to obtain information on the transfer of money to those countries," says Ninic.
However, he points out that the question is whether there is political courage for such a thing "given the relations of Aleksandar Vučić with the leaders of those countries".
"These relations are close, and the reconstruction of the railway line with the Railway Station in Novi Sad is the result of an agreement at a high state level on the sidelines of some meetings or lunches. Aleksandar Vučić had the opportunity to offer his brothers Xi, Macron and Orban to earn something on that infrastructure project. The Chinese did not find 'Starting' on Google, nor did anyone from 'Serbian Railway Infrastructure' find a Hungarian company that performed supervision or a French company on Google. "The very figures that appear in the contracts with the Hungarians or the French lead us to the conclusion that something is wrong," Ninic explains.

He states that the TOK is authorized to suspect and investigate a wide range of people and indicates that hundreds of people are involved in the implementation of that project.
"From the documents published so far, we learned that there are people from certain cabinets, people from the shadows who pulled strings in the name and at the expense of Aleksandar Vučić, such as the chief of staff of the President of Serbia, and those who do not appear in public, such as Nataša Vukšić. They left clues about it in that documentation. It is a big enigma who can come out if the prosecution seriously deals with the case. It is crucial to prosecute the people who agreed on the type, quantity and prices of the works, and the other screws in that pyramid of power only implemented it. "Here, the top of the state agreed on how much the reconstruction of the railway station will cost, all contractors and subcontractors had to conform to that agreement and implement the goals agreed on at the highest, interstate levels," Ninic concludes.
