Although they offered a lower price and rich experience, the companies Saturnia and "Stop Minama" were left without a secure contract. The Millennium Team's complaint revealed procedural errors - the Republican Commission found that all the formal conditions of the competition were not met and sent the procedure back for re-decision
The Republic Commission for the Protection of Rights in Public Procurement Procedures accepted the company's appeal The Millennium Team and partially annulled the decision to award a contract for clearing areas of remaining mines, worth almost a billion dinars, Nova ekonomiya writes.
The public procurement was announced by Ministry of Mining and Energy at the beginning of this year, and the estimated value of the work is 982 million dinars (8,3 million euros).
It was about cleaning suspicious areas from EOR (explosive remnants of war) at locations planned for the construction of self-balanced solar power plants.
The company Saturnia from Belgrade and the Mine Action Association "Stop Mines - Stop Mines" from Pale in Bosnia and Herzegovina offered to do this work for 865,3 million dinars, while the Millennium team asked for 981,75 million dinars - almost exactly what the maximum possible price was.
In March, Saturnia and Stop Mines, which have many years of experience in clearing areas of residual mines, were awarded the job.
Appeal against decision
The Millennium team filed an appeal against this decision, in which it states, among other things, that the selected bidder did not attach copies of certificates on quality assurance and environmental management standards.
The client of the work, the Ministry of Mining and Energy, stated that the Association "Stop Mines" is certified according to the required standards, and that all that remains is to finish the process of issuing the document itself, and that the certification process itself has been completed.
This was also said by the selected bidder, i.e. Saturnia and the "Stop Mines" Association.
The Republican Commission noted that the tender documents explicitly state that the criteria for job allocation are met by those candidates who possess valid certificates.
"From the factual situation established in the specific case, it follows that the selected bidder did not submit the evidence required by the tender documentation," the Commission stated.
The Commission took into account that the Millennium team presented other reasons for which it considers the offer of the selected bidder to be unacceptable, but did not consider them because it would not have an impact on a different decision in this case.
The client of the work is obliged to repeat the stage of expert evaluation of submitted bids, according to the decision of the Commission published on Wednesday on the public procurement portal.
