The hotel was demolished accompanied by the Kosovo police, and members of EULEX and KFOR are also on the scene, reports Kim radio. The demolition happened in front of the owner Jordan Jakšić, who said that he had invested in the building for 30 years.
The workers with machinery and accompanied by the Kosovo police arrived early this morning at the motel and the beach bar on the lake, one day before the expiration of the deadline given by the company "Ibar-Lepenac" to the owners to vacate the property.
The owners claim that their property was usurped, but before the demolition, they removed all the belongings from the building.
The removal of the first cottages, disputed for Kosovo, began at the end of June, and the public still has conflicting opinions about whether these cottages should be demolished. The Kosovo authorities claim that the buildings were illegally built on land managed by the public company "Ibar-Lepenac", while the owners state that the buildings are under litigation and that the demolition should not have been carried out before the proceedings were completed.
Criminal charges and hearing
Representatives of the company "Ibar-Lepenac", with the assistance of the Kosovo Police, gave the owner of the cottage on July 14 a deadline of 15 days to leave the hotel complex "Jezero" and the beach on the shore of Gazivode, which this public company considers its property.
In the meantime, the family, through its legal representative Predrag Arsić, filed a criminal complaint against the executive director of "Ibar-Lepenc", Faruk Mujka, on suspicion of threats, harassment and self-righteousness, as well as a state lawsuit with a proposal for determining a temporary measure that would prohibit the demolition or any change of the existing situation on the ground until the end of the court proceedings.
The lawyer claims that the representatives of the public company did not have an act that would represent a legal basis for this kind of action. As Kossev learns in the legal press, the hearing is scheduled for August 12, but first with a summons and information that a formal summons will arrive later.
What does the EU say?
After the previous wave of demolitions at Gazivode, the European Union requested an immediate suspension of further actions, warning of serious issues of compliance with legal procedures, the right to a fair procedure and the rule of law.
At the same time, the embassies of Germany and Great Britain called for full respect for the rule of law, while five civil society organizations from the north of Kosovo asked the World Bank to review the future support of JP "Ibar-Lepenac".
